Privacy Policy
Scope
This privacy policy informs users about the nature, scope and purposes of the collection and use of personal data by Balthasar-Neumann-Chor und -Ensemble e.V. (BNCE) in the mobile app, which is available through Apple’s App Store, and in the companion web app used in the browser.
When you download our app from the App Store, you identify yourself there, for example via your Apple ID. Apple’s privacy policies currently meet the requirements of the GDPR only incompletely. BNCE therefore cannot rule out that Apple uses the data collected from you at download for purposes not in line with the GDPR. BNCE, however, does not pass any data on to Apple or Google.

Handling of personal data
Protecting personal data is important to us. Data is therefore used for the performance of contracts or to fulfil legal obligations. In no case do we pass personal data on to third parties for advertising or marketing purposes. Data is only ever transferred with consent (Art. 6(1)(a) GDPR), for the performance of contracts or pre-contractual obligations (Art. 6(1)(b) GDPR), or to fulfil legal obligations (Art. 6(1)(c) GDPR), and always only to the extent necessary.
Use
The app serves the efficient management of projects that BNCE carries out in the form of rehearsals, concerts and workshops. Freelance musicians, singers and conductors take part in these projects and conclude contracts with BNCE for their participation. They receive access to the app from BNCE and can download it from the store mentioned above. Registration by persons not involved in the projects who download the app from the store is not possible.
BNCE uses the app to query and manage the availability of potential project participants. During the projects, the app serves to inform the actual participants about the organisational course of events (content, schedule and location).
The legal basis for this processing is accordingly the performance of contracts and pre-contractual obligations (Art. 6(1)(b) GDPR) and BNCE’s legitimate interest in carrying out its project management efficiently (Art. 6(1)(f) GDPR). Users of the app are project participants, BNCE and service providers engaged by BNCE (see below).

BNCE has concluded data processing agreements with both service providers.
Access data / server log files
The provider (or its web-space provider) collects data about every access to the service (so-called server log files). The access data includes: date and time of access, browser type and version, the user’s operating system, and the IP address.
The provider uses the log data only for statistical analyses for the purposes of operating, securing and optimising the app. The provider does, however, reserve the right to review the log data retrospectively where concrete indications give rise to a justified suspicion of unlawful use. When the data is no longer required because the purpose of its collection has been fulfilled, it is deleted.
Collecting the above-mentioned access data and storing it in log files is necessary for providing and operating the app. You therefore cannot object to this processing.
Cookies
The app does not use cookies for analytics or advertising purposes; the web app only sets one technically necessary session cookie for signing in.
Contact
Users can contact BNCE only outside our app: by post, telephone or e-mail. When users contact us, their details are stored for the purpose of processing the enquiry and in case follow-up questions arise.
Upload feature
For the upload feature in our app, the following data is collected, stored and processed in addition to the content uploaded by the user (a PDF document): surname, first name, telephone number, comment (optional). The data is collected to establish the authorship of the uploaded content and to contact and communicate with the user. The upload feature serves to upload statements and receipts for the user’s travel expenses so that the controller can reimburse them. The legal basis for this processing is accordingly the performance of contracts and pre-contractual obligations (Art. 6(1)(b) GDPR) and the controller’s legitimate interest in managing travel-expense accounting efficiently (Art. 6(1)(f) GDPR).
E-mail notifications
The app sends invitation and reminder e-mails to the e-mail address provided by the user — for example for a new project invitation or an invitation still awaiting an answer. The legal basis is the performance of contracts and pre-contractual obligations (Art. 6(1)(b) GDPR).
Data subject rights
Upon request, users have the right to receive, free of charge, information about the personal data stored about them (Art. 15 GDPR). In addition, users have the right to rectification of inaccurate data (Art. 16 GDPR), objection (Art. 21 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR) and erasure of their personal data unless a statutory retention obligation stands in the way (Art. 17 GDPR). Users furthermore have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR).
